The U.S. has strict immigration laws, and entry into the country can be denied to foreigners with certain criminal records. Factors that affect entry include the type of crime, the severity, and how long ago it occurred.
In general:
- Crimes involving moral turpitude (e.g., fraud, theft, violent crimes) can make a person inadmissible.
- Drug offenses, even minor ones, can lead to denial of entry.
- Felonies or serious misdemeanors may also bar someone from entering the U.S.
- However, minor infractions, crimes committed a long time ago, or situations where someone was pardoned may not always result in a refusal of entry.
Some people may be eligible for waivers or special permissions to enter the U.S., even with a criminal record, but this is handled on a case-by-case basis by U.S. immigration authorities. It’s recommended to consult with an immigration lawyer if someone with a criminal record is planning to visit the U.S.
